I can shed some light onto this.
That design was originally done for MiniCooper as part of an ad campaign without Hasbro being involved in any way whatsoever. One of my friends did the 3D modeling on it. One of the requirements they were given by MiniCooper was that they only use physical parts in the car, which is why you don't see a normal looking head, and why the arms and legs look weird.

Nope, I don't know anything about the political bull honkey between BMW and Hasbro. I was mainly addressing the look of the figure, which my friend complained about being limited to physical items in the car.

the same thing that limited the "realism" of the old C4 commercial
(that doesn't look like an alternator toy - they gave them a more mechanic look)
IMO, if you want to use a brand (whitout the right to do so) to appeal a larger audience, do it better
