Hasbro Cease and Desist Order

Post by TFArchive »

Hey everyone, for those who haven't read the announcement on the main page yet, here is the situation:

Today I got a letter from a lawyer representing Hasbro, telling me to remove anything that infrindged on Hasbro's copyrights and trademarks. This included episodes, movies, comics and images.

So as of right now, all episodes, movies and comics sections are offline.

I'll keep you guys updated if anything changes.

If it's not asking for too much, could you post the text of the letter. I would like to see what position thye are claiming. I can understand the comic scans, but I don't understand their beef with a few other things.

The episodes were broadcasted over public airwaves, no?

I don't think I should post the letter.

Yes they were aired but they are still Hasbro/Takara property, it doesn't matter how you get them they are still illigal to distribute.

OK, fair enough.

Still, that would make it illegal to tape a TV show and give it to a friend, right? I know that taping shows IS legal if I'm watching them.

Move the server?

Might be a coincidence, but Seibertron is down... Transfans is still up, though this may be because Omega seems to have little to do with thete right now...

The question I cannot answer is exactly how are they served by trying ot cripple these sites. I understand asking for the comics to be removed, but all images is a joke. There is some free use allowed. Especially if it's to educate people about something.

Incidentally, I have my suspicions as to who raised the matter with them... and I also know who I blame for upping the ante recently. Most of the comics & eps are fairly reasonable requests as both media are back in circulation these days...

Can we rent a server in Russia, then?

As soon as I can log back into Topcities, my given home address WILL be changed, as will probably my name... Although would TC be bound by their TOS not to reveal this? And Yahoo?

Denyer, are you thinking MEGATRON???

TOS tend to mean little with free servers...

And no, I'm not. I've a sneaky suspicion a certain other site won't be around for much longer.

Are you sure its from Hasbro? I mean couldn't it just be someone screwing with the From thing on the email.

Again, possibly unrelated, but http://thetransformers.net gives a 404 [though someone said it wasn't showing up earlier - it did this evening, but minus any content...]...

Ok. Just had to check that possibility.

But it still doesn't make sense. Why do it now?

I wonder...

It doesn't make any sense. Admittedly any boycott would have negligible impact on sales [not to mention would go out the window when Unicron appears], but surely the free promotion is fantastic stuff? I mean, I wouldn't have shelled out £90 on the Titan TPBs if I hadn't read them first, or brought any RiD but for the consistent word-of-mouth the toys got here...

Well, call me paranoid Uni, but we weren't the only site to have a full comic run hosted... and when one gets too big for its boots...

*edit* Yeah, Titan are going to lose word-of-mouth on this... which is a shame. The publicity is good for 'em...

Christ, without 'net scans, I wouldn't have even bothered digging my TF comics out of the loft... Without episode downloads I wouldn't have spent £40 on DVDs... I wouldn't really hold TF comics in more than a nostalgic vein and wouldn't buying the DW stuff... that's got to be about £600 that Hasbro have made off me via this site rekindling interest...

I don't see having to remove the episodes & comic scans as a big thing.Yes it is a shame but can get tons of Transformers episodes via kazaa or Direct Connect. Also don't forget what's been released on DVD

And after all if it's the law you have to obey it.You might not agree with the law but breaking laws for any reason only leads to trouble.

So you did the right thing by complying:)

You might be mad about it but it was the right thing.

Yeah! F**k those Tibetan people, China! Transfan says it's okay!

(Compy: Now you just might have a case... ;) But he keeps doing it, so I'll keep prodding back.)

Incidentally, I also consider the requests reasonable... I just happen to consider Judge Dredd wannabes the lowest form of life. At least lawyers generally don't believe in what they say.
